General Terms and Conditions (GTC) for Bicycle Rental

1. Scope of Application

1.1 These General Terms and Conditions (GTC) apply to all contracts for the rental of bicycles and associated accessories (in particular locks, helmets, lighting) between the rental company ("Lessor") and the renter ("Customer").

1.2 Provisions deviating from these GTC shall only apply if they have been agreed between the Lessor and the Customer in text form. Conflicting terms of the Customer or terms deviating from these GTC shall not apply.

1.3 Use in connection with sporting or competitive events, in bike parks and at other sporting events is expressly excluded. Use shall take place exclusively on public roads or on generally accessible paths in compliance with the StVO (German Road Traffic Regulations).

2. Conclusion of Contract and Proof of Identity

2.1 The rental contract is concluded upon the customer's booking and its acceptance by the lessor. The lessor shall be entitled to refuse to conclude the contract without stating reasons.

2.2 Upon handover, the customer shall present a valid official photo identification document. The lessor shall be entitled to record a copy or the relevant data (e.g. name, address, identification number) for the purpose of performing the contract, insofar as this is legally permissible.

3. Rental Period, Extension and Return

3.1 The rental period shall commence upon handover and end upon proper return to the lessor within the opening hours or at an expressly agreed location.

3.2 An extension of the rental period shall require the prior consent of the lessor. In the absence of such consent, late returns shall be deemed to constitute a breach of contract.

3.3 In the event of a late return, the lessor may demand additional rental charges in accordance with the applicable price list as well as a contractual penalty for unauthorised withholding. Any further claims for damages shall remain unaffected.

4. Prices, Deposit and Payment

4.1 The prices stated in the price list on the day the contract is concluded shall apply. Unless otherwise stated, all prices are inclusive of statutory value added tax.

4.2 The lessor may require a reasonable deposit/security. The deposit shall be refunded following the proper return and inspection of the rental object.

4.3 Payment shall be made in advance upon handover, unless otherwise agreed. In the event of default in payment, the statutory provisions shall apply.

5. Handover, Condition and Notice of Defects

5.1 The bicycles are handed over in a roadworthy condition. The customer shall inspect the bicycle and accessories upon handover and report any obvious defects without undue delay.

5.2 If a defect arises during the rental period, the customer shall inform the lessor without undue delay and shall – insofar as is reasonable – cease using the bicycle. The lessor shall, at its own discretion, remedy the defect or provide a replacement bicycle. There is no entitlement to a particular model.

6. Scope of Use and Prohibitions

6.1 The bicycle shall be treated with care and used properly in accordance with the operating and usage instructions. It shall at all times be properly secured (e.g. obligation to lock the frame and to attach it to a fixed object using the lock provided).

6.2 The following are prohibited in particular: (a) modifications or tampering, (b) the carrying of additional persons (except a permitted child seat), (c) excessive load (observe weight limits), (d) off-road/downhill use, bike parks, races, competitions and other sporting events, (e) commercial use without express consent.

6.3 When riding, the customer shall comply with the applicable traffic regulations (in particular the StVO and StVZO, the German Road Traffic Regulations and Road Traffic Licensing Regulations). For e-bikes/pedelecs, the special statutory provisions shall be observed.

7. Liability of the Customer, Theft and Accidents

7.1 The Customer shall be liable for damages resulting from improper handling, breaches of these GTC or from the violation of statutory provisions, provided that the Customer is responsible for such damages.

7.2 In the event of theft or loss, the customer shall report the matter to the police without undue delay and inform the lessor. The customer shall be liable for the damage incurred up to the amount of the current market value, insofar as the customer is responsible for the theft/loss.

7.3 Accidents shall be reported to the lessor without undue delay; in the event of personal injury or substantial property damage, the police shall additionally be notified.

8. Liability of the Lessor

8.1 The lessor shall be liable without limitation for damage arising from injury to life, body or health, as well as for damage under the German Product Liability Act (Produkthaftungsgesetz).

8.2 In all other respects, the lessor shall be liable for damage only in the event of intent and gross negligence. In the case of ordinary negligence, the lessor shall be liable only for the breach of material contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for such contracts.

9. Cleaning and Conditions of Return

9.1 The bicycle shall be returned in a proper condition. Excessive soiling may be charged at a flat-rate cleaning fee in accordance with the price list.

10. Data Protection

10.1 The lessor processes the customer's personal data for the purpose of initiating, performing and settling the rental contract in accordance with the applicable data protection regulations (in particular the GDPR). Further information can be found in the lessor's privacy policy.

11. Right of Withdrawal in Distance Selling

11.1 Insofar as the customer is a consumer and the contract was concluded exclusively through the use of means of distance communication, the statutory provisions on the right of withdrawal shall apply. Exceptions under § 312g BGB shall remain unaffected.

12. Final Provisions

12.1 German law shall apply. Mandatory consumer protection provisions of the customer's state of residence shall remain unaffected.

12.2 If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction shall be the registered seat of the lessor.

12.3 Amendments and supplements to these GTC must be made in text form. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected (severability clause).
