General Terms and Conditions (GTC) for Bike Rental
1. Scope of Application
1.1 These General Terms and Conditions (GTC) apply to all contracts for the rental of bicycles and associated accessories (in particular locks, helmets, lighting) between the lessor (“Lessor”) and the renter (“Customer”).
1.2 Provisions deviating from these GTC shall only apply if they have been agreed upon in text form between the Lessor and the Customer. Conflicting or deviating terms and conditions of the Customer shall not apply.
1.3 Use in the context of sporting or competitive events, in bike parks, or at other sporting events is expressly excluded. Use is exclusively on public roads or generally accessible paths in compliance with traffic regulations.
2. Contract Formation and Proof of Identity
2.1 The rental contract is concluded through the Customer’s booking and acceptance by the Lessor. The Lessor is entitled to refuse to conclude the contract without stating reasons.
2.2 The Customer must present a valid official photo ID upon handover. The Lessor is entitled to make a copy or record the relevant data (e.g., name, address, ID number) for contract fulfillment, insofar as legally permissible.
3. Rental Period, Extension, and Return
3.1 The rental period begins with handover and ends with proper return to the Lessor during opening hours or at an expressly agreed location.
3.2 An extension of the rental period requires the prior consent of the Lessor. If no consent is given, late returns are considered a breach of contract.
3.3 In case of late return, the Lessor may demand additional rental fees according to the valid price list as well as a contractual penalty for unauthorized withholding. Further claims for damages remain unaffected.
4. Prices, Deposit, and Payment
4.1 The prices stated on the day of contract conclusion according to the price list apply. Unless otherwise stated, all prices include statutory VAT.
4.2 The Lessor may require a reasonable deposit. The deposit will be refunded after proper return and inspection of the rental item.
4.3 Payment is due in advance upon handover, unless otherwise agreed. In case of payment default, statutory provisions apply.
5. Handover, Condition, and Defect Notification
5.1 The bicycles are handed over in roadworthy condition. The Customer must inspect the bicycle and accessories upon handover and report obvious defects immediately.
5.2 If a defect occurs during the rental period, the Customer must inform the Lessor immediately and—where reasonable—not continue to use the bicycle. The Lessor will, at its discretion, remedy the defect or provide a replacement bicycle. There is no entitlement to a specific model.
6. Scope of Use and Prohibitions
6.1 The bicycle must be handled carefully and properly in accordance with operating and usage instructions. It must always be properly secured (e.g., frame locking and securing with the provided lock).
6.2 The following are prohibited in particular: (a) modifications or manipulations, (b) carrying additional persons (except permitted child seats), (c) excessive loading (observe weight limits), (d) off-road/downhill use, bike parks, races, competitions, and other sporting events, (e) commercial use without express consent.
6.3 The Customer must comply with applicable traffic regulations (especially road traffic regulations) when riding. For e-bikes/pedelecs, special legal provisions must be observed.
7. Customer Liability, Theft, and Accidents
7.1 The Customer is liable for damages resulting from improper handling, violations of these GTC, or breaches of legal provisions, insofar as the Customer is responsible for them.
7.2 In case of theft or loss, the Customer must immediately file a report with the police and inform the Lessor. The Customer is liable for the resulting damage up to the amount of the current value, insofar as the theft/loss is the Customer’s responsibility.
7.3 Accidents must be reported to the Lessor immediately; in case of personal injury or significant property damage, the police must also be notified.
8. Lessor Liability
8.1 The Lessor is liable without limitation for damages arising from injury to life, body, or health, as well as for damages under the Product Liability Act.
8.2 Otherwise, the Lessor is only liable for damages in cases of intent and gross negligence. In cases of simple negligence, the Lessor is only liable for breach of essential contractual obligations (cardinal obligations) and limited to the contract-typical, foreseeable damage.
9. Cleaning and Return Conditions
9.1 The bicycle must be returned in proper condition. Excessive soiling may be charged with a flat-rate cleaning fee according to the price list.
10. Data Protection
10.1 The Lessor processes the Customer’s personal data for the initiation, execution, and settlement of the rental contract in accordance with applicable data protection regulations (in particular GDPR). Further information can be found in the Lessor’s privacy policy.
11. Right of Withdrawal for Distance Contracts
11.1 If the Customer is a consumer and the contract was concluded exclusively using means of distance communication, the statutory provisions on the right of withdrawal apply. Exceptions under § 312g BGB remain unaffected.
12. Final Provisions
12.1 German law applies. Mandatory consumer protection provisions of the Customer’s country of residence remain unaffected.
12.2 If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is the Lessor’s registered office.
12.3 Amendments and additions to these GTC require text form. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected (severability clause).
